Rules & Regulations

1. GENERAL

1.1 Cold Storage & Giant Kids Run 2024 (“Event”) is organised by Cold Storage Singapore (1983) Pte Ltd (“Organiser”) in accordance with these Rules & Regulations (“Terms”) that are applicable to the Participants, which can be found at www.csgtkidsrun.com.sg (“Official Website”).
1.2 Please read these Terms carefully before submission of the online registration form. Completion and submission of the online registration form confirm your agreement to abide by these Terms and any other terms, conditions, rules and regulations as may be notified by the Organiser to the Participants from time to time, whether through the Official Website, by way of notification through any communication methods as provided by the Participant, or during the conduct of the Event.
1.3 The Participant agrees to: (i) provide true, accurate, current and complete information (including personal data) about the Participant required by the Organiser in the online registration form available in the Official Website (the “Registration Data”); and (ii) promptly update the Organiser if there are any changes to the Registration Data to keep it true, accurate, current and complete. To the extent permitted by law, the Organiser shall not be liable for any claim, demand, liability or action resulting from the Participant’s omission, neglect and/or failure to supply the Organiser with the updated Registration Data and the accuracy and completeness of such Registration Data.
1.4 The Organiser and/or its service provider may contact the Participant from time to time by email regarding the Event. Any notice sent to the email address registered with the Organiser shall be deemed as received by the Participant.
1.5 If the Participant provides any information that is untrue, inaccurate, not current or incomplete, or if the Organiser has reasonable grounds to suspect that such information is untrue, inaccurate, not current or incomplete, the Organiser may suspend or terminate the Participant’s registration and/or refuse any and all future use of the Official Website (or any parts thereof). Such decision shall be deemed final and conclusive and the Organiser shall not be held responsible for any disputes arising from or in connection with the suspension/termination of Participant’s registration and/or refusal of any use of the Official Website in connection with this provision.
1.6 These Terms shall be governed by and construed in accordance with the laws of Singapore, and the Participants and the Organiser agree to submit to the jurisdiction of the Singapore Courts.
1.7 The Organiser, its officers, employees, contractors and/or third-party service providers may take photographs, motion pictures, video, sound or any form of recordings during the Event, which may feature and/or include any Participant(s) and/or person(s) attending the Event. Each Participant consent to the use of the Participant’s photograph, voice, likeness and image in any broadcast of the Event and subsequent productions drawn from the photographs, motion pictures, and/or recordings (including any quotes from any Participant) for any legitimate purposes, including without limitation commercial advertising, broadcast and/or subsequent re-productions, in any publication and publicity materials, websites and social media platforms. By registering and participating in the Event, the Participant hereby releases the Organiser from any and all claims, demands, costs and liabilities that may arise from the use of such materials as described in this provision.
1.8 The Organiser reserves the right to amend these Terms from time to time without giving prior notification or any reasons thereof. By continuing to participate in the Event, the Organiser shall have the right to assume that the Participant accepted and agreed to the amended Terms.

2. REGISTRATION

2.1 Registration to the Event is open to residents in Singapore of all ages. Participants below 18 years of age need to seek parental or guardian consent before registering and participating in the Event. The Organiser has the absolute discretion to reject and refuse the registration and/or participation of a potential Participant without assigning any reason to the Participant, and to terminate such registration for any reason whatsoever.

2.2 The registration to the Event under “Woof-berry Run” category is subject to the following conditions:

  • The registration is open to all dog breeds;
  • Each registered dog must be at least over 12 months old;
  • Each registered dog must be in good health;
  • Participants might be required to provide proof of up-to-date vaccinations of each of their registered dog.

The Organiser has the absolute discretion to reject and refuse the registration of a potential Participant or dog to the “Woof-berry Run”
category without assigning any reason to the Participant, and to terminate such registration for any reason whatsoever.

2.3 The Organiser reserves the right to cancel or postpone the Event at any time. The Organiser shall not be obliged to notify the Participants of such cancellation or postponement. If the Event has to be cancelled or postponed, there shall be no refund of registration fees paid and the Organiser shall not be liable for any loss or inconvenience caused as a result of the cancellation or postponement of the Event.
2.4 The Organiser reserves the right to set the registration fees for the different categories as expedient to its intents and purposes.
2.5 Once the online registration form has been processed, there will be no refund of registration fees for those Participants who eventually do not take part in the Event or any registered categories, for whatever reason.
2.6 Participants who wish to withdraw from the Event must notify the Organiser before 2359hrs on 1 May 2024 in order for the Organiser to refund 50% of the registration fees paid by the Participant. Refunds will be made via cheque or such other methods as may be determined by the Organiser at its sole discretion. Withdrawal notifications must be in writing to info@csgtkidsrun.com.sg. Telephone and verbal notifications will not be accepted. Withdrawal after 1 May 2024 will not be accepted and there will be no refund of registration fees paid.
2.7 Participants may change the category of his or her participation to the Event by paying a $15 administrative charge for a change of category.
2.8 Participants who decide to change their category to a category of a lower value must do so before 2359 hrs on 1 May 2024. No refunds will be made for the difference in pricing. All change requests must be in writing to info@csgtkidsrun.com.sg. Telephone and verbal notifications will not be accepted.
2.9 Participants who wish to change their category to a category of a higher value must do so before 1 May 2024. Top-up of the price difference must be made for the change to take place. All change requests must be in writing to info@csgtkidsrun.com.sg. Telephone and verbal notifications will not be accepted.
2.10 The Organiser reserves the right to limit and refuse registrations/entries without assigning any reasons thereof.

2.11 The Organiser reserves the right to replace the race entry pack items with items of similar value.

3. RACE

3.1 The Organiser reserves the right to amend the Event routes as they deem fit for the safety of the Participants and/or to prevent any potential hazards in the conduct of the Event, at any time without prior notice to the Participant. In such cases, a reasonable effort will be made to inform the Participant prior to the date of the Event. The Organiser shall not be liable for any loss or inconvenience caused due to such changes.
3.2 Participants, including registered dogs under the “Woof-berry Run” category, must wear their assigned number bib at all times during the conduct of the participating category of the Event. Participants, including registered dogs under the “Woof-berry Run” category, without the allocated bib number will not be allowed to take part or continue to take part in the Event. The Organiser shall not be held for any claim, demand, liability or action resulting from or in connection with the Participant’s omission, neglect and/or otherwise failure, howsoever caused, to wear the assigned number bib and/or any damage to the assigned number bib which is not attributed to the Organiser.
3.3 All dogs are to be harnessed and leashed at all times. The following dogs and their related crosses must always be leashed and muzzled: Bull Mastiff, Bull Terrier, Doberman Pinscher, German Shepherd or related Shepherd Dog breeds, Rottweiler, Perro de Presa Canario. The Organiser reserves the right to deny entry for any Participants and their registered dogs who do not comply with these Terms. Dogs without a leash are not allowed to participate in the Event for the safety of others.
3.4 The Organiser reserves the right to delay the commencement of the Event as a result of inclement weather. Should the inclement weather persist after the delay, the Organiser reserves the right to cancel the Event without refund of registration fees.
3.5 “Gun Time” will be used to determine the winners for competitive categories. Gun time is the time from the start signal until the runner crosses the finish line.
3.6 For podium finisher appeals, both the prize winner and possible prize winner must be present. Appeals must be made on-site in person to the Event officials, in a written format, at least 30 minutes before the prize presentation that will be held on the same day. All appeals are subject to a $50 appeal fee. The appeal fee will only be refundable upon successful appeal. There will be no refund for unsuccessful timing appeals. The Organiser’s decision is final and reserves the right not to entertain any appeals submitted after 2 June 2024.

3.7 The Organiser reserves the right to replace any winners if such winner is found to be disqualified.

3.8 Any aggression exhibited by the registered dogs during the Event may lead to disqualification. Participants are accountable for their dog’s behaviour and must maintain control at all times.

3.9 Participants who do not start within 30 minutes from their respective flag-off point will be disqualified and for safety reasons, may not be allowed to start.

3.10 Participants below the age of 18 are required to seek parental/guardian consent and fill up the relevant indemnity form when registering online, failing which, the Organiser reserves the right to refuse entry to that Participant.

3.11 Except for registered dogs for the participation in the “Woof-berry Run” category, no other pets, or any form of wheel-run objects of transport e.g. inline skates, prams, push cars, shoes with built-in or attached rollers is allowed on the course during the Event.

3.12 If baggage deposit services are provided on the day of the Event, any baggage deposit is at the sole risk of the Participant and the Organiser will not be held responsible for any loss and/or damage, personal or otherwise, to the belongings and items deposited. The Organiser also reserves the right to check any item or baggage deposited for security and/or safety reasons.

4. MEDICAL SAFETY

4.1 Whilst reasonable precautions will be taken by the Organiser to ensure the safety of Participants, Participants take part in the Event at their own risk and the Organiser, each of the sponsors and appointed officials shall not be liable for any death or injury, loss or damage, suffered or otherwise, and howsoever arising.

4.2 The Organiser reserves the right to remove any Participant deemed physically and/or mentally incapable of participating or continuing to participate in the Event to prevent him/her from causing greater harm and injury to himself/herself.

4.3 Participants are strongly encouraged to go for a medical examination and/ or consult their medical practitioner prior to registration and before the actual day of the Event. For the safety of Participants, Participants are advised to run on the designated route and observe traffic regulations.

5. CONFIDENTIALITY AND PERSONAL DATA

5.1 By visiting the Official Website, submitting the Participant’s Registration Data onto the online registration portal and/or participating in the Event, the Participant consents to the Organiser’s collection, use and disclosure of the Participant’s Registration Data for any or all of the purposes stated in the Privacy Statement.

5.2 The Participant’s Registration Data will be handled in accordance with our Online Privacy Policy. Please read our Online Privacy Policy for an explanation of the Organiser’s practices and policies relating to the collection, use, storage and retention of the Registration Data.
5.3 Personal data collected from the online registration and held by the Organiser will be kept confidential and will only be used, disclosed, stored and processed by the Organiser and/or its service provider(s) pursuant to the purposes of which such Registration Data are given to the Organiser under these Terms including without limitation the registration and participation in the Event via the online registration portal. Nevertheless, the Organiser may provide this information including the Registration Data to third parties including without imitation to the Organiser’s advertisers, associated companies, contractors/agents, or other network service providers who perform certain tasks for the Organiser in connection with the Event, or other provision of services to the Organiser and/or the Participants. All such third parties are required to keep confidential of any information received from the Organiser and are prohibited from using Registration Data except to provide the requisite services to the Organiser.
5.4 The Organiser may disclose Registration Data to any applicable authorities without notice, only if required to do so by law or in the good faith belief that such disclosure is deemed necessary to the Organiser.
5.5 The Organiser’s use or processing of Registration Data shall be done solely in a manner consistent with the terms of these Terms. The Organiser also confirms that it has taken appropriate technical and organizational measures intended to prevent the unauthorized or unlawful processing of Registration Data and the accidental loss or destruction of, or damage to, Registration Data. The Organiser may send marketing and promotional materials to the Participant relating to future events and/or activities, or relating to the Organiser’s products and offerings. The Participant shall contact the Organiser to withdraw such marketing and promotional materials consent if the Participant does not wish to receive such materials.

6. DISCLAIMER; LIMITATION OF LIABILITY

6.1 The Organiser does not represent or warrant that the online registration portal and/or the Official Website will be available, that access will not be interrupted (including any scheduled maintenance and/or disruption in telecommunication network affecting the transmission that is beyond reasonable control of the Organiser), that there will be no delays, failures, errors or omissions or loss of transmitted information (including any unforeseeable disruption in telecommunication network affecting the transmission). The Participants have sole responsibility for providing adequate protection of Registration Data (e.g. no sharing of password, etc.) and back up of data and/or equipment and for undertaking reasonable and appropriate precautions to scan for viruses or other destructive properties.
6.2 Without limiting to the foregoing, all information, content and materials contained in the online registration portal and/or Official Website are provided on an “as-is” basis. The Organiser assumes no responsibility and shall not be liable (to the extent permitted by law) for any damage or injury arising out of your registration and participation in the Event or access to the online registration portal and/or Official Website, or any failure of performance, error, omission, interruption, deletion, defect, delay in operation or transmission, computer virus, communication line failure, interception of online communication, software or hardware problems (including without limitation loss of data or compatibility problems), whether for breach of contract, tortious behaviour, negligence or under any other causes of action.

7. WAIVER AND INDEMNITY

7.1 By using and accessing to the online registration portal and/or the Official Website, and by taking part in the Event, the Participant agrees, to the extent permitted by law, to indemnify and hold the Organiser, its directors, employees, its sponsors, agents, and third party service providers harmless with respect to any claims arising out of your breach of these Terms, your use of the online registration portal or any action taken by the Organiser as part of its investigation of a suspected violation of these Terms or as a result of its finding or decision that a violation of these Terms has occurred.
7.2 To the extent permitted by the law, the Organiser shall exclude all liabilities and shall not be liable to the Participants for any claim, proceedings, losses, damages, etc. arising from or in connection with your participation in this event and the race. This means that the Participant cannot sue or recover any damages from the Organiser, its directors, employees, sponsors, agents and third party service providers as a result of the Organiser’s decision to remove or refuse to process any information or content, to warn you, to suspend or terminate your registration or your participation in the race, or to take any other action during the investigation of a suspected violation or as a result of the Organiser’s conclusion that a violation of these Terms has occurred, to the extent permitted by law. This waiver and indemnity provision applies to all violations described in or contemplated by these Terms.

ACKNOWLEDGEMENT

1. I hereby represent, warrant and undertake to the Organiser the following with full knowledge that they shall be relied upon by the Organiser in accepting my registration:

i. My personal particulars disclosed in the registration form are accurate, full and complete;
ii. I do not have any medical condition that would affect my safety or physical well-being;
iii. I am medically and physically fit and competent to participate in the Event; and
iv. I shall dutifully and fully abide by these Terms and any applicable laws.

2. I confirm that the representations, warranties and undertakings herein are true and accurate.
3. I (including my heirs, successors and assigns) undertake not to make any claims or lodge any complaints whatsoever against the Organiser, sponsors or officials of the Event for any injury, death or loss/damage to property sustained during the Event/disputes over any matter in relation to the Event.
4. I (including my heirs, successors and assigns) agree to hold the Organiser, sponsors, appointed officials/suppliers (each an ‘Indemnified Party’) harmless and keep each Indemnified Party fully and effectively indemnified from and against any and all losses, costs (including legal costs on a full indemnity basis), claims, damage and expenses whatsoever which any of them may incur (directly or indirectly) as a result of my breach of any of these Terms.
5. I am agreeable to the Organiser or its appointed vendor to SMS or email me on any service related updates with regards to this event purpose only.
6. I understand and accept that my registration may be revoked or terminated if any of the representations and warranties are untrue or inaccurate, and such revocation and/or termination shall not entitle me to any refund of the registration fees.
7. Risks in any competitive or athletic activity. Training for, practicing or competing in running events involves frequent and repetitive use of the arms and legs, extreme fitness and endurance, and pushing the limits of the participant’s speed and abilities.
8. Risks present in an outdoor environment. Participants may be subject to: high altitude or mountainous terrain; severe storms or bad weather such as lightning, strong winds, rain, hail, snow and ice; fast moving or deep lakes, oceans or other water bodies; currents or whitewater; extremely hot or cold weather; stinging, venomous and/or disease carrying animals (including marine life) or insects and other natural or man-made hazards. Hazards may not be marked or visible and weather is always unpredictable.
9. Running risks. These risks include the risk of losing control and falling to the ground, colliding with objects (including parked or moving vehicles and/or bicycles) or people (including co-participants, volunteers, or spectators) on land, tripping or falling down, or encountering other road/trail hazards.
10. Personal health and participation risks. THE RISK OF EXPOSURE TO COMMUNICABLE DISEASE(S), INCLUDING BUT NOT LIMITED TO COVID-19, INHERENTLY EXISTS IN ANY PLACE WHERE PEOPLE ARE PRESENT, INCLUDING BEFORE, DURING, AND/OR AFTER THE EVENT AND ACTIVITIES. THE ORGANISER HAS PUT ENHANCED HEALTH AND SAFETY MEASURES IN PLACE DUE TO THE POTENTIAL SPREAD OF COVID-19 AT ALL EVENT-RELATED VENUES. I MUST FOLLOW ALL INSTRUCTIONS WHILE VISITING ANY EVENT-RELATED VENUE, WHETHER POSTED OR OTHERWISE COMMUNICATED VERBALLY OR IN WRITING. COVID-19 MAY BE CONTRACTED FROM OTHER PERSON(S) (INCLUDING BUT NOT LIMITED TO ANY CO-PARTICIPANT; SPECTATOR; THE ORGANISER, SPONSOR, REPRESENTATIVE, VOLUNTEER, OR CONTRACTOR; AND/OR ANY OTHER PERSON(S)). COVID-19 IS AN EXTREMELY CONTAGIOUS DISEASE THAT CAN LEAD TO SEVERE ILLNESS, PERMANENT DISABILITY, AND DEATH. ACCORDING TO THE WORLD HEALTH ORGANIZATION, SENIOR CITIZENS, AND PERSONS WITH UNDERLYING MEDICAL CONDITIONS ARE ESPECIALLY VULNERABLE. BY VISITING ANY EVENT-RELATED VENUE, I VOLUNTARILY ASSUME ALL RISKS RELATED TO EXPOSURE TO COVID-19 IN THE PARTICIPATION OF THE EVENT AND THE ACTIVITIES. The risk that a participant’s mental, physical, or emotional condition (including any use or abuse of alcohol or prescription or non-prescription drugs), whether disclosed or undisclosed, known or unknown, combined with participation in these activities could result in injury, damage, death or other loss. Although the Organiser may review the participant’s medical information, submitted in the registration process, the Organiser cannot anticipate or eliminate risks or complications posed by a participant’s mental, physical (including fitness level), or emotional condition.
11. Equipment risks. The risk that equipment used in activities may be misused, or may break, fail or malfunction. Participant (and/or the participant’s legal guardian) assumes full responsibility for choosing appropriate equipment and for the fit and condition of the equipment.
12. Supervision and activities risks. I understand that neither the Organiser, Sponsor nor each of its staff, representatives, volunteers, contractors or anyone associated with them will be supervising participant during the activities or at any time. Adult participant agrees he/she is solely responsible for his/her own well-being at all times; or, if applicable, a participant’s legal guardian agrees to take sole responsibility for the participant’s supervision before, during, and after the Event and other activities, including during free time and at all other times.
13. I will review all materials received, accurately complete and agree to the registration information, documents and process, and rules and policies. I will obey all rules and policies, which include the Event and all traffic laws.
14. By submitting this entry, I agree to be bound by and comply with all policies, procedures and/or other rules adopted by the Organiser(as may be amended from time to time and at any time by the Organiser), and the authority given to the Organiser under those rules.

15. My final acceptance and participation in the Event is contingent upon the Organiser’s receipt and review of all required information and form;

16. I am fully capable of participating without causing harm to myself or others. I further agree that participating in these activities may require extreme fitness and endurance, that I am solely responsible for my conditioning and fitness before, during, and after the activities, and that I, in conjunction with my physician, am responsible for determining whether these activities are appropriate for me, before I participate;

17. The Organiser contracts with individuals or organizations that are independent contractors (not its employees or agents) to provide some of the Event services and to conduct some of the activities participants will engage in. I acknowledge that the Organiser does not supervise or control these independent contractors and is not legally liable or responsible for their conduct. In addition, activities take place on premises or at facilities not owned or controlled by the Organiser, and the Organiser does not oversee or take responsibility for any aspect or condition of these independent facilities or premises;
18. The information provided in this Acknowledgement is not exhaustive, other unknown or unanticipated activities, inherent or other risks and outcomes may exist, and the Organiser cannot assure my safety or eliminate any of the risks. I understand I can and should consult the Organiser’s representatives if I have further questions about the activities or the associated risks; and
19. I am voluntarily participating with knowledge of the risks. Therefore, I assume and accept full responsibility for myself and my child, for the inherent and other risks (both known and unknown) of the activities, and for any injury, damage, death or other loss I or my child may suffer, resulting from those risks, including but not limited to the risk of my, a co-participants, a spectator’s, a volunteer’s and/or a third party’s passive or active negligence or other misconduct.
